Sign Up for Snowball Express Holiday Shop

1. PAYMENT TERMS: Due upon receipt of invoice. 2% interest will be added to your Group account each month after the first twenty one (21) days. Group Account will be deemed in default and delinquent if not paid in full within thirty (30) days of invoice date and subject to any and all collections practices.
2. PRODUCT TERMS: Snowball Express will be the sole provider of products for your Holiday Shop. Group is not permitted to mark, price, or sticker product. No credit will be given on returned product that has been marked, priced or stickered.
3. RETURNS: All unused merchandise must be returned within twenty-one (21) days of the Sale End Date for a credit to be issued. If not returned within twenty-one (21) days of the Sale End Date Group will be responsible for the cost of all merchandise received.
4. ONLINE SALES: All online voucher sales will have a 3-5% convenience fee paid by the shopper/end customer. There is no cost to the Group.
5. BONUS: $250 @ $2,500, $500 @ $5,000, $750 @ $7,500 and $1,000 @ $10,000 in sales to be discounted from Group’s invoice. Group discount may be reduced if returns exceed 20% of total product shipped.
6. TAXES: This merchandise has been sold for resale purposes only. This organization is responsible for any collection and/or remittance of any sales or use taxes which may be required by state law.
7. CHOICE OF LAW and VENUE: Any dispute(s) arising from this transaction(s) shall be governed by the laws of Ohio. Any and all claims, disputes, or other litigation which arises from this transaction(s) shall be brought within a court of competent jurisdiction of Stark County, Ohio.
8. AGENT DESIGNATION: Unless Group designates an alternate in writing, the person signing the agreement will be considered the Group’s only official representative with respect to this agreement.
9. COLLECTION COSTS, LITIGATION COSTS, AND ATTORNEYS’ FEES: Group is responsible for payment of any and all court, litigation, and collection costs associated with collection of default and delinquent accounts, including but not limited to: all litigation costs, court costs, interest, and/or attorneys’ fees for collection of the same.
10. EXECUTION REQUIRED: Group understands and agrees Diamond Fundraising will not process any transaction(s), including but not limited to ordering of goods/productions, procuring or preparing shipments and/or any other aspects of the transaction process until a properly executed Sales Order Agreement is received by Diamond Fundraising as set forth by the Sales Terms herein.
11. By signing below, I hereby certify that the above organization has given me the authority to conduct this sale. I agree to the terms and details of the agreement and I will be responsible and personally guarantee for payment in full.
